"The action comes as Kerik, who was released from prison last year, is raising serious questions about Tacopina’s representation of him in 2006 and 2007, when the former top cop faced a barrage of criminal charges, first in the Bronx and then in federal court.
Kerik pled guilty to eight federal felonies in 2009. He claimed in the bar complaints that Tacopina secretly cooperated with federal prosecutors against him after they subpoenaed Tacopina’s records in 2007 and forced him to cease representing Kerik.
Kerik’s malpractice suit against Tacopina echoes claims in the bar complaints, including an allegation that the Brooklyn-born lawyer schemed to defraud Kerik out of a seven-figure finder’s fee in a real estate deal and also jeopardized Kerik’s liberty by contacting him on Dec. 9, 2007, after Tacopina had become a government witness and had been instructed not to contact his former client.
The suit claims Tacopina “sold Mr. Kerik down the river through a “series of events reminiscent of ‘The Godfather.’ ” According to the 84-page complaint, Tacopina secretly cooperated with federal prosecutors against Kerik and schemed to defraud Kerik out of a seven-figure fee in a real estate deal. Tacopina also jeopardized “Mr. Kerik’s bail conditions and liberty interests,” according to the complaint, by contacting Kerik at a time when Tacopina was a formally listed as a government witness against him."
